Man sues lifeguard, police after almost drowning in pool

FAIRFAX CO. – A man says he is suing Fairfax County Police and a lifeguard, because they didn’t rescue him when he almost drowned.

You can see in a video, police and a lifeguard are standing around the pool.

The lifeguard finally entered the pool after 24-year-old Michael Fijalkowski says he was underwater for more than two minutes during a bipolar episode.

According to the lawsuit, he says he had stopped breathing and had no pulse by the time the lifeguard finally pulled him out.

However, police say they followed protocol and tried to save the lifeguard from a disturbed person.
